Measures on Administration of Defected Consumer Products Recall to apply in January

General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (AQSIQ) issued No. 151 Notification of Year 2015 to publish Measures on Administration of Defected Consumer Products Recall (hereinafter referred to as “Measures”) on 21 October 2015. The Measures will enter into force on 1 January 2016.
 
The Measures is applicable to the recall of consumer products manufactured or offered for sale in the People’s Republic of China. Producer, the entity for the recall of defected consumer products, refers to any enterprise incorporated in the People’s Republic of China to manufacture consumer products according to law with product conformity certifications, any enterprise to import consumer products overseas to offer for sale in China or authorised organs incorporated in China by foreign enterprises.
 
Electrical & electronic equipment and children’s products listed on the catalogue of consumer products for recall administration shall be subject to the Measures. As for the recall of other unlisted consumer products, the Measures can serve as a reference. It deserves special attention that the Measures is not applicable to tobacco and related products, motor vehicles, civil aviation, civil ships, food, drugs, cosmetics, medical devices, pesticides and those products otherwise stipulated by laws and regulations.
