OEHHA intends to list bromodichloroacetic acid under Prop 65

California’s Office of Environmental Health Hazard Assessment (OEHHA) has issued a notice of its intent to list bromodichloroacetic acid on Proposition 65 as a substance known to the state to cause cancer on 27 May 2016.

NTP (2015) Bromodichloroacetic acid can form when water containing natural organic matter and bromide is disinfected with chlorine-containing oxidizing compounds.
 
The action is being proposed under the authoritative bodies listing mechanism, based on a 2015 National Toxicology Program (NTP) report on the substance. Comments are welcome to be submitted before 27 June 2016.

The Prop 65 compliance procedures are quite complicated. Prop 65 itself sets no limits for hazardous substances but only safe harbour levels. While substantial data are required from businesses to apply such safe harbour levels. Currently, Prop 65 regulates hazardous substances in products as per limits and test methods provided in the existing lawsuits or settlement agreements for the same product category.
