US CPSC withdraws testing exemption for unfinished and untreated wood in toys

US CPSC withdraws the final rule in determining that final rule on heavy metal limits of unfinished and untreated wood under ASTM F963-11 that unfinished and untreated wood in toys requires no testing for heavy metals on 4 September 2015. The rule was expected to be effective since 15 September 2015, but it doesn’t survive the public comment. So it is notable that compliance test is still necessary for heavy metals in unfinished and untreated wood in toys that to be placed in the US market since 10 September 2015.
 
Currently, the Commission received “significant adverse comments”, which resulted in the withdrawal of the rule. The CPSC judges a comment 'significant' if it contains content that merits a response, and if it is within the scope of the rulemaking. It will address these comments in a separate final action based on the July 17, 2015 notice of proposed rulemaking published in the same issue of the Federal Register. In addition, a second public comment will not be initiated.
