CFDA issues notification on the filing of imported cosmetics for non-special purposes

On 17 January 2017, China Food and Drug Administration (CFDA) issues Notification No.7 of 2017 that all cosmetics for non-special purposes imported for the first time from the port at Shanghai Pudong New Area and the registration site of their responsible person in China is located at Pudong New Area shall be subject to filing administration instead of approval administration since 1 March 2017 to 21 December 2018.

In response to requirements of State Council’s Temporary Adjustment of Administrative Regulations in Pudong New Area and Decisions on Administrative Approval in its Documents (G.F.(2014) No. 24), the notification as regards implementing filing administration on imported cosmetics for non-special purposes in Pudong New Area as a pilot site are as follows:

I. All cosmetics for non-special purposes shall be subject to filing administration instead of approval administration since 1 March 2017 to 21 December 2018, if the two criteria are met:

1. The cosmetic products are imported for the first time from the port at Shanghai Pudong New Area; and

2. The registration site of their responsible person in China is located at Pudong New Area.

II. Filing procedures are required for all cosmetics for non-special purposes through filing system, by which operations can gain filing certificates which is necessary for import trade.

III. If the cosmetics for non-special purposes imported for the first time go through filing products as per the Notification and will be imported from ports other than Shanghai Pudong New Area , the filing information of the products shall be canceled. In this case, cosmetic products can only be imported with administrative approval for the first time as per the stipulations of Regulations Concerning the Hygiene Supervision over Cosmetics.

IV. Supervision Department of Food and Drug shall intensify cooperation with Exit-Entry Quarantine and Inspection Departments to promptly release product safety information and will crack down violations with competent departments. Departments responsible for filing administration implementation shall promptly notify Exit-Entry Quarantine and Inspection Departments of businesses that have filed the product information serving as a basis for the verification of Exit-Entry Quarantine and Inspection Departments by laws.
