European Commission consults on two new RoHS exemptions

European Commission has commissioned BiPRO to hold a stakeholder consultation for two new RoHS exemptions, which runs six weeks from 28 October 2016 to 9 December 2016.

Interpretation on EU RoHS exemptions

Besides restrictions of hazardous substances (10) in EEE, RoHS Directive also prepares Annexes III and IV listing exemptions based on current technology level and socioeconomic benefits to adapt to technical and scientific progress. The exemptions will be irregularly updated. It is noted that hazardous substances under the product category or for the specific application within the exemption period can be exempt from RoHS restrictions.

Existing exemptions for which a renewal request has been submitted remain valid until a decision on the renewal request is taken by the Commission. The Commission decision on renewal request(s) for an exemption will either indicate the new expiry date in case of renewal, or, in case of rejection, grant a transition before the exemption expires, i.e. a period of minimum 12 months, maximum 18 months following the decision date. In contrast, exemptions for which no application for renewal was submitted in due time will expire on the date specified in RoHS 2 Article 5 or in RoHS 2 Annexes.
